Terms of Use

This is a courtesy translation of the German Nutzungsbedingungen (AGB). Where the two differ, the German version is the legally binding one.
1. Scope
These terms of use apply to the use of Max TD (the "game"), available at maxtd.io and td-ted-s-defence.web.app, offered by Max Anders (see Legal Notice).
2. Description of the service
Max TD is a free-to-play browser tower defence game. An account is optional and serves solely to back up your progress across devices. The game is funded by optional reward videos that you choose to watch (watch-ad rewards); there are currently no purchases with real money (in-app purchases).
3. Registration and minimum age
To create an account you must be at least 16 years old or have the consent of a parent or guardian. By registering you actively confirm that you have read and accept these terms and our privacy policy. You are responsible for keeping your credentials confidential.
4. Virtual items
Virtual items earned in the game (including "diamonds") have no real monetary value, are not transferable, not tradable, and cannot be exchanged for or paid out as real money. They do not constitute gambling in the legal sense: rewards (for example from the chest) are granted guaranteed for watching a reward video, and choices within the game (for example upgrades) always present visible, fixed options — there are no hidden random odds ("loot boxes").
5. Permitted use
The following are prohibited in particular:
- cheating, manipulating saves or leaderboards, automated play (bots or scripts)
- reverse engineering, decompilation or circumventing technical protection measures, unless expressly permitted by law
- offensive, unlawful or deceptive display names in the public leaderboards
- any use that impairs the operation of the service or harms third parties
6. Account suspension
In the event of breaches of these terms, in particular where cheating is detected (server-side plausibility validation of leaderboard entries), we reserve the right to reset individual entries or to suspend the account concerned.
7. Availability and changes
We endeavour to keep the service running as uninterrupted as possible, but cannot guarantee constant availability. We reserve the right to change, extend or discontinue features of the game.
8. Limitation of liability
We are liable without limitation in cases of intent and gross negligence, and for culpable injury to life, body or health. In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded to the extent permitted by law.
9. Intellectual property
All content of the game (artwork, sounds, code, game mechanics) is protected by copyright; for details on the AI-assisted and subsequently reworked artwork see the Legal Notice. Any use beyond playing the game as intended is not permitted without consent.
10. Final provisions
German law applies. Mandatory consumer protection provisions of your habitual place of residence within the EU remain unaffected. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
